Intellectual Property Law

I have been practicing patent law since graduating in 1982 from GWU Law School.  In 1986, I joined Hughes & Luce in Dallas to manage the Firm's intellectual property practice.  In 2000, I joined Akamai Technologies in Cambridge.  After three years at Akamai, I returned to private practice in Texas.  

I was admitted to practice before the United States Patent & Trademark Office (PTO) in 1981. For the past 35 years, I have written, prosecuted, licensed and enforced patents for many companies and institutions.   Some of my representative patents are available here

As Akamai's patent counsel, I manage the Company's patent litigation activities, including Limelight v. Akamai, which was recently decided by the U.S. Supreme Court.  

I have extensive experience in district court patent litigation.   As lead trial counsel, I obtained a $10 million jury verdict in the Eastern District of Texas, and that verdict was later enhanced and then affirmed on appeal.  I have argued before the Federal Circuit, as well as the PTO Patent Trial & Appeal Board (PTAB).

I also have expertise in PTO administrative proceedings including Inter Partes review (IPR) and PTAB appeals.

I draft and negotiate contracts including patent licenses, technology transfers and licenses, software licenses, trademark licenses, sponsorship agreements, technology development agreements, outsourcing agreements, joint venture agreements, distribution agreements, agency agreements, e-commerce agreements, domain name agreements, book publishing agreements, creative rights licensing, work-for-hire agreements, and many others.  I frequently consult with clients on issues involving open source software. 

I provide IP due diligence in corporate transactions. For example, I negotiated the intellectual property divestiture when General Motors sold EDS.  I also have extensive experience in trademark, copyright and trade secret law, including procurement, licensing and enforcement activities. 

I received my Bachelor of Science in Electrical Engineering from GWU with distinction in 1978. I have been licensed to practice in Texas since 1982.
